General Conditions

TERMS, CONDITIONS AND REGULATIONS OF RENTAL

1) RENTAL: The Boutique Apartment promotes and concludes tourist rentals of Tourist Apartments in the name and on behalf of the owners of the aforementioned properties.

2) PAYMENT METHODS: Upon receipt of the booking confirmation, the customer must pay 100% of the total amount of the rental. Payments must be made to the Boutique Apartment by bank transfer or credit card.

3) RENTAL VOUCHER: The Voucher with all the data regarding the reservation will be issued by Boutique Apartment after receipt of the balance of the rental and it will indicate the itinerary to reach the accommodation or any other meeting point for the delivery of the keys. It is forbidden to give the Voucher to others or to show up with a number of people greater than that indicated on the Voucher, or that of the places available in each housing unit, except for children up to three years of age. Any substitution of person during the rental period is prohibited, unless previously agreed with Boutique Apartment. Failure to comply with these clauses will give the owner of the property the right to refuse access to the customer in the rented housing unit. In the event that such failure occurs during the stay, the owner may request immediate removal and the customer will not be entitled to any refund. The customer may also be removed if during the stay he behaves in a manner contrary to the most basic rules of civil education (breaks objects, makes a mess, etc.).

4) RENTAL PRICES: The rental price is intended for the rented housing unit, delivered clean, and includes: (unless otherwise indicated on the booking voucher), hot and cold water consumption, electricity, cooking gas, heating, air conditioning, bed linen and towels. Does not include: the security deposit, etc. Any other additional service requested by the customer must be paid on site. Final cleaning is regulated by the following Art. 6 letter C unless otherwise indicated on the voucher.

5) ARRIVAL - DEPARTURE AND SECURITY DEPOSIT:
a) Arrival at the booked accommodation must take place in the afternoon from 2:00 pm. In the event that on the day scheduled for arrival, the customer is delayed, he is obliged to notify Boutique Apartment by calling +39 347 4440245. In the event of a delay not communicated to Boutique Apartment and the owners represented by it, they decline all responsibility and will not recognize the customer reimbursements for expenses of any kind and the accommodation will be delivered the following day.
b) Upon arrival, the customer is required to present the Booking Voucher and an identity document (passport or identity card) of all people to the owner of the booked property, or his representative, in order to allow registration with the competent authorities. The customer is in any case responsible towards the owner for any damage caused to the house. On the day of departure, customers must vacate the houses by 10.00 in the morning, in order to allow the owner or his representative to check and clean the house before the arrival of new guests.
c) The accommodations are delivered clean and tidy.
d) The owner or his representative reserves the right to access the rented house to carry out essential routine maintenance operations (garden, pool cleaning, etc.).
e) PETS: pets are allowed only in the accommodations where expressly indicated. At the time of booking, the customer must inform Boutique Apartment of the presence of any animals and their number. In some cases, a supplement is required, which will be indicated on the voucher, to be paid on site to the owner.

6) COMPLAINTS: All the houses are periodically checked by the Boutique Apartment staff and the descriptions in the catalogue are written with care and in perfect good faith. If, exceptionally and without the knowledge of the Boutique Apartment, changes have been made to the rented accommodations, the latter declines all responsibility but will work promptly to verify and resolve any problem. Any complaints must be sent to the Boutique Apartment, in writing via email to the address: info@boutiqueapartment.org, within 48 hours of the client's arrival. Complaints not reported in writing, within the terms indicated above, cannot be taken into consideration. In the event of a complaint, Boutique Apartment reserves the right to verify on site and during the client's stay, through its representative, the reasons for the complaint, and the client for his part undertakes to grant Boutique Apartment the necessary time to try to resolve any problem. In the absence of the above written communication, customers who abandon the accommodation before the scheduled date will lose any right to a possible refund of the rental price and will not be reimbursed in any case for hotel expenses and other costs incurred. Boutique Apartment does not recognize as justified causes for complaint atmospheric events, insect bites, lack of electricity, gas or water if this depends on the service providers.

7) RESPONSIBILITY: If causes of force majeure prevent the reserved accommodation from being made available to customers, Boutique Apartment reserves the right to assign another accommodation with similar or superior characteristics, or in extreme cases to cancel the reservation by refunding the tourist the amount paid for the rental without the latter being able to make further requests for compensation of any kind. Acceptance of the new accommodation extinguishes any right to any refunds or requests of any kind.

8) CANCELLATIONS: In the event that for any reason a customer should cancel the reservation, the same will NOT be entitled to a refund of the amount paid.

9) MODIFICATION OF RESERVATIONS: Modifications to reservations already made, which involve a change in the holiday period and/or accommodation, which should reach our offices in the 45 (forty-five) days prior to the start of the rental, will be considered CANCELLATIONS and governed by the cancellation conditions reported above. The customer is advised to stipulate, at the time of booking, a suitable insurance contract, in order to prevent the negative consequences of a cancellation.

10) INSURANCE: Boutique Apartmentin compliance with the laws in force (International Convention on Travel Contracts C.C.V. pursuant to Italian Law of 27.12.77 n. 1084 and EEC Directive 90/314 of 13.06.90) and in order to protect its customers has stipulated the following policy with Vittoria Assicurazioni: Civil liability insurance policy and coverage of risks arising to people from participation in travel and stay programs, pursuant to Art. 13 of the Tuscany Region Law no. 16/94 and subsequent amendments and additions and with the maximum amounts established and approved by the Tuscany Regional Council with resolution no. 5823 of 30/05/94. Policy stipulated with Vittoria Assicurazioni in order to guarantee tourists and the properties used during the stay.

11) ADDITIONAL CLAUSES: with his booking confirmation the customer confirms for all legal and rational purposes the acceptance of these general rental conditions. The customer cannot attribute to Boutique Apartment or the owner the consequences of his eventual ignorance of these contractual conditions. The houses and apartments published on the website www.boutiqueapartment.org are partly tourist accommodation facilities, and partly private homes. Therefore these properties do not have categories recognized in a homogeneous way by the international tourist world, but reflect the owner's personal taste and local traditions in their architecture and furnishings.

12) COMPETENT COURT: For any legal dispute, the competent court for the territory is the Public Prosecutor's Office at the Court of Siena. This contract is governed by Italian Law. Boutique Apartment is liable only in accordance with the provisions of Italian Laws that regulate real estate activities.

13) PROTECTION OF PERSONAL DATA: In order to conclude the rental contract, Boutique Apartment requires some of the customer's personal data. Pursuant to and for the purposes of art. 13 of EU Regulation 2016/679 (GDPR), we hereby communicate that, in relation to the Customer Information on the Processing of Personal Data made available by you to Boutique Apartment, we hereby inform you that these will be processed to respond to the specific purposes connected to the tourist rental of holiday homes. The processing of your Personal Data will be carried out using suitable paper, electronic and/or telematic tools, with logic strictly related to the purposes indicated above and, in any case, in such a way as to guarantee the security and confidentiality of the Data itself. The material collected will be used exclusively for the purposes indicated above. Some Personal Data may be communicated to any parties who provide Boutique Apartment with services or performances instrumental to the purposes indicated above. Your Personal Data will be processed for the time necessary to carry out the purposes indicated above and will be retained for the time necessary or according to the terms of the law. Rights: access, updating, rectification, integration, cancellation, limitation of personal data processed, including those no longer necessary to pursue the purposes for which they were collected; have information about the logic, methods and purposes of the processing.
